You agree to comply with all applicable U.S. export laws and regulations. You represent and warrant that you are not located in a country that is subject to U.S. government embargo or designated as a 'terrorist supporting' country.
These terms and conditions are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under these terms will be resolved in the state or federal courts located in New York, New York.
Padel, racket sports, fitness activities, and use of related facilities and equipment involve inherent and obvious risks that cannot be eliminated without jeopardizing the essential qualities of the activity. These risks include, without limitation: slips, trips, falls; collisions with walls, glass, nets, doors, other participants, or equipment; being struck by balls or rackets; muscle strains, sprains, tears, cramps; overexertion; adverse weather or surface conditions (for any outdoor/partially open areas); equipment failure or misuse; and other hazards associated with vigorous physical activity in a shared environment.
By participating, you represent that you are in good physical condition and have no medical condition that would make participation unsafe. You understand Padel& staff are not medical providers. You authorize Padel& personnel to seek emergency medical care on your behalf if needed and agree to be financially responsible for any associated costs.
To the fullest extent permitted by applicable law, you voluntarily assume all risks of injury, illness, property damage, or loss arising out of or related to your participation in activities at Padel& and your use of Padel& facilities, programs, leagues, clinics, events, and equipment, whether occurring before, during, or after your visit.
To the maximum extent permitted by applicable law, you hereby release, waive, and discharge Padel&, its owners, affiliates, officers, employees, contractors, and agents from any and all claims, demands, causes of action, damages, losses, costs, or liabilities arising from or related to your participation and use of the facilities and equipment, except that this waiver is not intended to, and does not, waive liability for Padel&’s own negligence where such a waiver is prohibited by law. For New York participants: this waiver is not intended to release Padel& from liability for its own negligence where prohibited, including under N.Y. General Obligations Law § 5-326.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Padel& from third-party claims arising out of your violation of these Terms, your negligent or wrongful acts, or misuse of the facilities/equipment. This does not require you to indemnify Padel& for Padel&’s own negligence where prohibited by law.
You agree to follow all posted rules, staff instructions, and league/clinic policies, to use appropriate footwear and protective gear, to inspect courts and equipment before use, and to stop play and notify staff if you observe unsafe conditions or feel unwell. Padel& may remove any person who violates safety rules or acts in a manner that endangers others.
You are responsible for your personal belongings. Padel& is not responsible for loss, theft, or damage to personal property brought onto the premises, except as required by law.
A parent or legal guardian must review and accept these Terms on behalf of any minor participant and remains responsible for the minor’s compliance with safety rules. Nothing in this section is intended to waive a minor’s rights where such a waiver is not enforceable under applicable law.
You grant Padel& permission to photograph or record your participation and to use such content for legitimate business purposes (marketing, social media, website), without compensation, unless you opt out by notifying hello@padeland.us in writing before your session.
If any part of this section is held unenforceable, the remainder shall continue in full force and effect to the maximum extent permitted by law.
